These Terms of Service ("Terms") govern your access to and use of Arena Buddy (the "Service"), provided by Jamie Livingston Dierks ("we", "us", or "Arena Buddy"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Arena Buddy is a rodeo tracking application that lets riders log runs, horses, events, expenses, and earnings across disciplines such as barrel racing, team roping, breakaway roping, and tie-down roping.
2. Eligibility & Account
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use Arena Buddy. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must provide accurate information and keep it updated.
3. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose, fraud, or spam;
- infringe any third party's intellectual property or privacy rights;
- upload malware, attempt to probe, scan, or breach security, or scrape the Service;
- resell, redistribute, or share your account access with others;
- reverse engineer or attempt to circumvent technical limits of the Service.
4. Your Content
You retain ownership of the run logs, horse records, photos (including Coggins and health papers), and other content you upload. You grant Arena Buddy a limited, worldwide license to host, store, and process your content solely to operate and improve the Service for you.
5. Intellectual Property
Arena Buddy, including its software, design, and branding, is owned by Jamie Livingston Dierks and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your active subscription or invite.
6. Payment, Subscriptions & Billing
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refunds are governed by the Paddle Checkout Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled.
7. Beta & Invite Access
Users who joined Arena Buddy during the beta with a valid invite keep free access to the Service for as long as they maintain their account in good standing and continue to use it without lapse. Invite-based access is personal and non-transferable, and may end if the account is terminated for breach of these Terms.
8. Suspension & Termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time from your Billing page; access continues until the end of the paid period.
9. Service Availability & Warranties
The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid for the Service in the 6 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold Arena Buddy harmless from any claim arising out of your content, your use of the Service, or your breach of these Terms.
12. Changes
We may update these Terms from time to time. If we make material changes, we will notify you by email or within the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Exclusive venue for any dispute lies in the state and federal courts located in Wood County, Texas.
